RE: The tariff classification of a headlamp subassembly from Germany

Dear Mr. Epstein:

In your letter dated December 21, 1993, on behalf of North American Lighting, Inc., you requested a tariff classification ruling. You have submitted descriptive literature and a sample of the product.

The imported product is a motor vehicle headlamp subassembly (which is a housing designed to hold the lamp's electrical features). The subassembly will be combined with other lamp components in the United States. The finished article will be a complete elliptical headlamp used on a BMW sport vehicle.

The subassembly is composed of a metal housing metal and a small glass cover. The metal housing measures approximately 6 inches high. The housing measures approximately 4 inches in diameter (at its widest point), approximately 3 inches in diameter at its front portion (which holds the glass cover), and approximately 2 inches in diameter at its rear portion. The applicable subheading for the subject motor vehicle headlamp subassembly will be 8512.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for parts of lighting equipment, of a kind used for motor vehicles. The rate of duty will be free.

This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).

A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
